Terms of Service

These terms are an agreement between you and SITETOOLS, Inc. ("SITETOOLS", "we", "us"), which runs PhotoText.com ("PhotoText", "the service"). By using PhotoText you agree to these terms and to our Privacy policy. If you don't agree, please don't use the service.

1. The service

PhotoText is an online photo editor. You can open a photo, find and change text that's already in it, add and style new text, erase objects, apply adjustments and download the result. Some features cost credits. We may add, change or remove features over time.

2. Accounts and sign-up checks

• You can use the editor without an account. To save projects or buy credits you need an account, created with your email address or through Google, Facebook or X.
• You must give your real name and an email address you own, and you must be at least 13 years old (or the minimum age in your country, if higher).
• To keep out fake accounts and abuse, new sign-ups are checked automatically, including your name, email address and IP address (see our Privacy policy). We may refuse a sign-up that doesn't pass these checks, for example from a disposable email address, a VPN or a hosting network.
• You're responsible for keeping your password safe and for everything done with your account. One person, one account.

3. Emails

When you create an account, we may email you about your account and about new features, updates and related PhotoText news. You can stop update emails at any time with the unsubscribe link in each email or in Account settings. Emails you need for your account, like confirming your address, are always sent.

4. Credits and payments

• Editing is free. Credits pay for downloading a photo without the watermark (the price per photo is shown before you download) and for other features we may add. Prices and the number of credits in each pack are shown before you pay.
• Credits never expire. They have no cash value, can't be transferred to another account or exchanged for money, and can only be used on PhotoText.
• Payments are processed by Stripe. We never see or store your card details.
• Purchases are non-refundable, except where the law requires a refund. We may give a refund at our discretion, for example after a duplicate or mistaken charge, by writing to support@phototext.com. Credits from a refunded purchase are removed from your account.

5. Watermarks

Downloads carry a "PhotoText.com" watermark unless you choose to download without it. A download without the watermark costs credits, charged once per photo (each edited page of a PDF counts as one photo; pages you don't edit are free); downloading the same photo again without the watermark is free. You may not remove or hide the watermark by other means.

6. Acceptable use

You agree not to use PhotoText to:

• create, edit or share anything illegal, or anything that sexually exploits or harms minors;
• forge or alter documents, IDs, receipts, certificates, tickets, signatures or other records in order to deceive anyone, or to commit fraud;
• infringe anyone's copyright, trademark, privacy or other rights, or impersonate a real person or organization;
• harass, threaten or defame anyone, or create content meant to mislead people in a harmful way;
• upload malware, try to break into or overload the service, scrape it, or get around its limits, sign-up checks or payments.

We may remove content and suspend or close accounts that break these rules, and we may report illegal activity to the authorities.

7. Your content

• You keep all rights to the photos you upload and the images you create. You must have the right to use any photo you upload.
• You give us permission to store, process and display your content only as needed to run the service for you: for example, reading text in your photo, saving your projects and creating your downloads. We don't sell your content or use it to advertise.
• You can delete your projects at any time from My projects. Deleted projects are removed from our servers, and from our backups within 30 days. We may also delete saved photos automatically after a period of time; when we do, the rules will be posted in our Privacy policy.

8. No warranty

PhotoText is provided "as is" and "as available". Text recognition, Magic erase and other automatic features can make mistakes, so check your results before you use them. To the fullest extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted, error-free or fit for a particular purpose. Keep your own copies of important photos.

9. Limitation of liability

To the fullest extent the law allows, SITETOOLS will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of PhotoText. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or US$50, whichever is greater. Some places don't allow these limits, so they may not all apply to you.

10. Ending your use

You can stop using PhotoText at any time, and ask us to close your account by writing to support@phototext.com. We may suspend or close your account if you break these terms or if we have to by law. If we close your account without cause, we'll refund any unused paid credits. Sections 3, 6 (deletion), 7, 8 and 11 continue to apply after your account is closed.

11. Changes to these terms

We may update these terms. When we do, we'll change the date at the top of this page, and for important changes we'll tell you on the site or by email. If you keep using PhotoText after a change, you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of California, USA. Any dispute will be handled in the courts of Los Angeles County, California, unless the law of your country gives you the right to bring it elsewhere.
